West Virginia Man charged with Assault/battery for passing gas

CHARLESTON, W.Va. (WSAZ) -- As if getting a DUI wasn’t enough, a man arrested for driving under the influence got in a lot more trouble at the police station.

Police stopped Jose Cruz on Route 60 in South Charleston Monday night for driving with his headlights off.

Then, he failed sobriety tests and was arrested.

When police were trying to get fingerprints, police say Cruz moved closer to the officer and passed gas on him. The investigating officer remarked in the criminal complaint that the odor was very strong.

Cruz is now charged with battery on a police officer, as well as DUI and obstruction.
 
Well if that's the case then some of the troops around here should get life!  ;D

Then I too am a lifer, as I often clear the office out here, and even get blamed for it when its not me, ha!

Seriously, a criminal record for a fart is outragous, and the judge should throw the charge out of court when/if it goes that far. It is a waste of resources well beyond a joke. However if he spat on him, or did some other body fluid 'assault' then fair enough, but for a simple beer fart, well thats plain stupidity.

NOVEMBER 21--A 12-year-old Florida student was arrested earlier this month after he "deliberately passed gas to disrupt the class," according to police. The child, who was also accused of shutting off the computers of classmates at Stuart's Spectrum Jr./Sr. High School, was busted November 4 for disruption of a school function. A Martin County Sheriff's Office report, a copy of which you'll find below, notes that the 4' 11" offender admitted that he "continually disrupted his classroom environment by breaking wind and shutting off several computers." The boy, whose name was redacted from the police report released today, was turned over to his mother following the arrest.

I'm thinking in this case, the actual disruption was shutting off the computers.  Seriously, can people "break wind" deliberately?  ::)
 
I believe they should make beans and such an illegal substance then.
