Simon Logan v. Her Majesty The Queen

Reg force, would have only been collecting PLD (i guess, but I don't remember getting PLD in Halifax,) because I got posted to the JPSU.
I was released in 2015, I am still on SISIP. I am probably one of the least complicated payouts, I haven't received anything while I guess others have. but there is a lot of different information coming from a lot of places.
I do know for myself for a fact as Reg Force I was collecting PLD from 2004-2009 (Halifax) then while on IR from Halifax from 2009-2011 so I'm guessing I should receive something. That's like 7 years in total of collecting PLD (Halifax).

The question is not "did you ever receive an allowance" but rather " what allowances were you in receipt of on your day of release"?

Ooof, this whole 50% , 70% of class member's payments just seems like a convenient way to pay nobody. Has ANYONE received payment, or even communication stating what their payment could look like? Are we getting interest for the delay? If I'm getting an allowance that should have been paid to me 10 years ago, I should get at least 50% interest added to that.

Yes, a lot more people are getting paid. If your someone that is still on sisip LTD beyond the 2 year mark then expect to be more towards the end of the line. They started paying all the members that only did 2 years or were age 65 and over first which is a lot of people. From my guess it looks like they are just finishing those people up and are now coming back around to those still on SISIP. The deadline is June 2025 so there is still a lot of time left for payments. Just remember each month that goes by is another month owed to you if still on SISIP.

If you want to argue interest you would have to ask the lawyers that. You are able to estimate your payment if you know the amount of the allowance you were receiving times that by the amount of months you are on SISIP for only going back to 2012 if you happen to be out before then. Then take off 30% for taxes and another 16.5% for lawyer fees. Now you can try to figure out the annual increase for inflation for each year to if you want to be a lot more accurate. It should give a rough idea of what to expect.

Where are you getting your info on this? I have tried talking to both the law firm and SISIP and both keep telling me to talk to the other one.

I'm still on SISIP, and haven't heard anything really, has any one still on SISIP heard anything? Or at least a notification?

There is a group on Facebook for current lawsuits. A lot of people have mentioned being paid out but those that have been paid are the 2 year people. There are some that have been paid that are still on SISIP but not many.

I'm still on SISIP but I don't expect anything until the Spring time.

If you've been confirmed apart of the lawsuit then basically just have to wait. Only 9 1/2 months left to go now anyway.

I just got letters regarding the my LTD adjustment.

I came off Manulife LTD July 2018. I assume they are working their way up chronologically. I was on Manilife LTD for 2 years.

But this feels to be moving pretty fast.

I did receive payment earlier this summer. Which I assumed was this. But no paperwork.

For those who've received payment, is there an automatic income tax deduction, or will that be something we have to set aside ourselves?
For anyone who's interested, I'm going to make an appeal for an inflation adjustment on my tax filing. For example, if they expect tax on an allowance from 2019, and inflation since then has been at least 25%, I'll be calculating my income tax rate from 2019, and then subtracting the inflation adjustment. If they don't like it at the CRA, we can take His Majesty to court.

There is an automatic tax deduction as well as a 16.5% deduction for lawyer fees. The breakdown sheet you receive for the calculations break it down by year and month so you can apply it to previous years. You can also claim your lawyer fees but will need to get a receipt from the lawyers.

As someone who is barely understanding what's going on, is frustrated with SISIP, and isn't even sure that they're involved, I'm not sure what, if anything I can do in regards to inflation and taxes.

You are all talking about an automatic deduction for taxes, SISIP takes the bare minimum of taxes off my regular payment, and I know there are forms I can fill out, but dealing with them and VAC is just, tiresome. I have contacted SISIP for more information, they told me to contact the law firm, the law firm told me to contact SISIP, so it's round and round in circles just like every other time.

Has anyone still on SISIP recieved any payment or paperwork?

I have not yet. Manulife is expected to be at 50% of claimants paid out by end of next week Oct 18th. They then expect to be at 70% paid out by end of December.

I'm sure there's some that have been paid out still on SISIP but the vast majority of the 50% are those that only did 2 years or turned 65.

I assume and this is just my opinion that SiSIP will start back at the earliest releases and start working they're way back up thru the years for those still on SISIP.

Depending on the size of your payment SISIP will take 30% off for taxes.

For your taxes if you are needing more taken off I would speak to an accountant to figure out the proper amount that you need taken off and then I would have that amount deducted from your IRB as it is easier to deal with VAC for this as the form can be found or requested thru your my VAC account. You can also see what is being withheld for taxes on my VAC account anytime you need whereas SISIP you have to call and request pay stubs and it's just a much longer process.

RedCastleBows: I 3B released in 2019 and am still on SISIP and I've received not a single peep or a single $. I get it, they're taking years to pay people even though a simple spreadsheet and normal data entry process could have this done in a matter of a month or 2, they're pinching pennies once again on staff to save money and screw Veterans. They already got an extension.

I think its worthwhile for us all to come together in an effort to request an inflation adjustment on these arrears. Not only has the value of the money plummeted since we were legally entitled to it, but we also suffered financial loss by not having it for that period of time. I'm fine with paying the legal fees, but if I'm paying tax on this I'm subtracting inflation from the tax owed, and will begin the process by appealing to the CRA and letting them tell me what paperwork I might need to support that.

Can someone point me in the direction of the Facebook groups where people are looking for info on this? Some keywords or a partial url would be great.

This Facebook group covers all lawsuits and has a lot of posts about the Logan one.
