Stoker (MAR ENG TECH) to UTPNMC and spec pay

SO, as some of you know, the Mar eng world is one few trades with Certifications at different levels. I just finished my QL 5 and now receive Spec Pay, but am still currently doing my CERT 2. I just received my UTPNCM offer for RMC with an Ocdt date effective June 1. MY timeline for my cert 2 is to be complete by July 31st. I was told today that the career manger said if by my completion date I have not received my Cert 2 that he would start the processes of recouping my Spec pay retroactive to date of completing my QL5. I asked for a reference of this in writing and received a "Because the career manager said so". I've been looking and haven't found anything that says he can...or for that matter that he can't. Can anyone point me in the right direction?

Question 2. My current TOS end in August. If I still never had a Cert 2, and was a month over, would they still recoup Spec pay?

It isn't that I don't want to do a Cert 2, or am trying to be lazy. I have to prepare for a move (IE sell house and etc). If I was to have a Cert 2, I would have to go to sea for all of April if not longer for trainning. So that would  really add some time constraints.

SUBJ: ADVANCE NOTIFICATION - SPECIALIST PAY OCCUPATIONAL STRUCTURE IMPLEMENTATION PLAN (OSIP) FOR NCMS

1. THE ADMINISTRATION OF SPECIALIST PAY WAS CHALLENGED IN THE 2003 CHIEF OF REVIEW SERVICES REPORT ON THE BASIS THAT PERSONNEL WHO WERE NOT TRADE QUALIFIED WERE IN RECEIPT OF SPECIALIST PAY. CHANGES TO THE CF PAY SYSTEM (CCPS) HAVE NOW AFFORDED US THE OPPORTUNITY TO RECTIFY THIS SITUATION IN ENSURING THAT ASSIGNMENT OF SPECIALIST PAY IS ADMINISTERED APPROPRIATELY. THEREFORE, A NEW MOC STRUCTURE WILL BE INTRODUCED THROUGH SUBJECT OSIP AND WILL ADDRESS THE ISSUE THAT ONLY TRADE QUALIFIED PERSONNEL RECEIVE SPECIALIST PAY

2. FOR AFFECTED OCCUPATIONS, BOTH REG F AND P RES SUB-DIVISIONAL CONSTRUCTS WILL BE CREATED IN HRMS EFF 1 AUG 04. MBRS PROMOTED ACTING LACKING WILL REMAIN IN THE JUNIOR OCCUPATION UNTIL ALL OCCUPATIONAL QUALIFICATIONS REQUIREMENTS OF THE RANK ARE SUCCESSFULLY ATTAINED AND WILL BE PAID AT THE STANDARD TRADE GROUP. ONCE TRADE QUALIFIED, THAT MBR WILL BE COMPULSORY TRANSFERRED TO THE APPLICABLE OCCUPATION AND BE REMUNERATED ACCORDINGLY (SPEC 1 OR SPEC 2)

3. AS A MINIMUM REQUIREMENT, IN ORDER FOR AN INDIVIDUAL TO BE ASSIGNED TO A HIGHER TRADE GROUP, THE MBR WILL HAVE TO BE SUBSTANTIVE (QL5A QUALIFIED) LS/CPL RANK. THE METHOD OF QUALIFICATION FOR EACH QL WILL STILL BE DETERMINED BY THE MANAGING AUTHORITY (MA)

4. TRANSITIONAL INSTRUCTIONS: THE RULE WILL BE IF YOU ARE IN RECEIPT OF SPECIALIST PAY IAW CURRENT REGULATIONS PRESENTLY IN EFFECT AS OF 31 JUL 04, YOU WILL CONTINUE TO RECEIVE SPECIALIST PAY. HOWEVER, AFTER THAT DAY ALL OTHER PERSONNEL IN OR ENTERING A SPECIALIST MOC WILL BE REQUIRED TO BE A SUBSTANTIVE LS/CPL IN ORDER TO BE ASSIGNED TO A HIGHER TRADE GROUP

5. FOR CLARIFICATION, SEE THE FOLLOWING EXAMPLES:

(1) ANYONE OT'ING FROM A STANDARD PAY GROUP MILITARY OCCUPATIONAL STRUCTURE IDENTIFICATION (MOSID) INTO A SPECIALIST OCCUPATION AFTER 31 JUL 04 WILL BE PLACED IN THE JUNIOR OCCUPATION MOSID AND BE PAID AT THE STANDARD PAY GROUP UNTIL THEY HAVE ACHIEVED THE QUALIFICATIONS REQUIRED FOR THAT OCCUPATION SUB-DIVISION (SEE DPPD WEBSITE FOR COMPLETE LIST OF ALL NCM OCCUPATIONS).

(2) THE ONLY EXCEPTIONS WILL BE FLT ENGR AND NDT TECH OCCUPATIONS WHERE ANY MBR O'TING TO ANY OF THOSE TWO MOCS MUST COME FROM A SPECIALIST MOC, THEREFORE, THOSE MBRS WILL RETAIN THEIR RATES OF PAY WHILE UNDERGOING TRG AND BE TRANSFERRED TO A HIGHER TRADE GROUP ONCE TRG IS SUCCESSFULLY COMPLETED

So, if your MPRR states that you are a Mar Eng Tech 00122, then regardless of your training (unless you went to a TRB and lost your rank or were forced to remuster) your pay should not change. I hope this helps, I am not an expert, but go talk to your pay office on ship if possible and ask them what they think.
